Personal Data Protection (GDPR)

1. Basic provisions 

• The controller of personal data pursuant to Article 4(7) of Regulation (EU) 2016/679 of the European Parliament and of the Council on the protection of natural persons with regard to the processing of personal data and on the free movement of such data (hereinafter referred to as "GDPR") is CZECH , 114/23 Ban Bo Fai, Hua Hin Subdistrict, Hua Hin District, Prachuap Khiri Khan,  Thailand (hereinafter referred to as "CZECH THAI").

2. Sources and categories of personal data processed 

• CZECH THAI processes the personal data you have provided.

• CZECH THAI currently uses cookies on its website to make its website and services more attractive and improve them. Cookies are small text files that are stored on the visitor's computer, but they do not contain any viruses and cannot cause any damage.

• CZECH THAI takes all reasonable measures to ensure that personal data that is inaccurate, taking into account the purposes for which it is processed, is deleted or corrected without delay.

• Categories of personal data processed:

• Identification data – name, surname, title, date of birth, birth number, permanent address, signature, for natural persons who are entrepreneurs – ID number, VAT number, and bank details

• Contact details – contact address, telephone number, e-mail address

• Other data – job position, qualifications, amount on the document, earnings data, work report, overview of training completed

3. Purpose of personal data processing
We process your personal data to the extent necessary to provide the service in question. We process personal data for the following reasons:

• Legal obligation – regulations imposed on us by the laws of Thailand and the Czech Republic (e.g., the Accounting Act, the Value Added Tax Act, the Archives and Records Management Act)

• Legitimate interest – we always carefully assess the existence of a legitimate interest (enforcement of unpaid claims, securing evidence in case of the need to defend the rights of CZECH THAI CO., LTD.)Direct marketing (sending information about job offers or other commercial communications)
  Consent of job applicants to the processing of personal data for the purpose of job placement. Personal data may be used to improve our services, including analyzing website user behavior for the purpose of optimizing its functioning.
  Personal data may be used for business and marketing purposes, i.e. to maintain a database of website users and to offer goods and services, for the duration of the legal basis for this type of processing and use of personal and other data. 

• Legitimate interest – we always carefully assess the existence of a legitimate interest (enforcement of unpaid claims, securing evidence in case of the need to defend the rights of CZECH THAI CO., LTD.)

4. Data retention period 

• We only retain your personal data for as long as is necessary and archive it in accordance with statutory retention periods. We process personal data for the duration of the contractual relationship or other legal basis that allows us to process your personal data. Once the legal basis no longer applies, we delete the relevant personal data.

• We only store personal data that we process with your consent for the duration of the purpose for which consent was given.

5. Recipients of personal data (subcontractors)
We process and store the personal data you have provided to us within CZECH THAI CO., LTD. In certain cases, the processed data may be made available to other entities. We only provide personal data to other persons to the extent necessary for the performance of the service. We always verify that the processor of your personal and other data complies with laws and regulations. Whether we process your personal data ourselves or through a processor authorized by us, your personal and other data obtained is always protected against misuse. Personal data is processed electronically in an automated manner or in printed form in a non-automated manner.

a) We use the following personal data processors:

• External collaborators of CZECH THAI CO., LTD. and suppliers for the purpose of fulfilling the contract

• IT service providers

• Marketing service providers

b). In justified cases, we may also transfer your personal data to other entities:

• Public authorities and other entities, if required by applicable law.

• Other entities in the event of an unexpected event in which the provision of data is necessary to protect life, health, property, or other public interests, or if it is necessary to protect our rights, property, or security.

c). Personal data will not be transferred to third countries outside the EU.

6. Your rights 

1. Under the conditions set out in the GDPR, you have:

• The right to access your personal data pursuant to Article 15 of the GDPR

• The right to rectify personal data pursuant to Article 16 of the GDPR or to restrict processing pursuant to Article 18 of the GDPR

• The right to erasure of personal data pursuant to Article 17 of the GDPR

• The right to object to processing pursuant to Article 21 of the GDPR

• The right to data portability pursuant to Article 20 of the GDPR

• The right to withdraw your consent to processing in writing or electronically to the address or email of the controller specified in Article III of these terms and conditions

2. You also have the right to lodge a complaint with the Office for Personal Data Protection if you believe that your right to personal data protection has been violated.

7. Personal data security conditions 

• We declare that we have taken all appropriate technical and organizational measures to secure personal data. We have taken technical measures to secure data storage and personal data storage in paper form.

• Only persons authorized by us have access to personal data.

8. Final provisions
CZECH THAI CO., LTD. reserves the right to amend this privacy policy and the general terms and conditions without prior notice. Users and visitors can always find the current version of the general terms and conditions and current information on personal data protection at www.thaireal.cz. These terms and conditions shall take effect on September 28, 2024.
